DOMESTIC VIOLENCE
Domestic Violence is a serious offense. The police and the Prosecutors aggressively pursue the prosecution of people who are accused of spousal or child abuse. Domestic Violence involves an assault upon or a threat against a family or household member. In all likelihood, if the police respond to a domestic violence call, someone is going to be charged, arrested and incarcerated.

If you are charged with Domestic Violence, a Temporary Protective Order will usually be issued by the Court as a condition of your being released on bond pending the outcome of the case. This will often prevent you from having any contact with the family member who is the alleged victim and will often prevent you from going to your home or having contact with your children. This is true even though you have not yet been convicted of any crime.

The penalties for a Domestic Violence conviction can be serious and life changing. Generally, a conviction for Domestic Violence as a first degree misdemeanor, can never be sealed or expunged from your record.
